1. About NDGE

NDGE is an AI-powered audio platform offering short, on-demand hypnotherapy-style sessions (“NDGEs”) designed to help you make positive changes in habits, thoughts, and behaviours.

NDGE is not a substitute for professional medical advice, diagnosis, or treatment. If you have health concerns, please seek advice from a qualified healthcare provider.

2. Eligibility

  • You must be at least 16 years old to use NDGE.

  • If you are under 18, you should have a parent or guardian review and agree to these Terms with you.

3. Service Access

  • NDGE is provided via Squarespace’s platform.

  • We aim to make NDGE available 24/7 but cannot guarantee uninterrupted service due to maintenance, updates, or events beyond our control.

  • We reserve the right to modify or discontinue any part of the service without prior notice.

4. Accounts and Subscriptions

  • You may need to create an account to access certain features.

  • Subscription fees are billed monthly in advance via Stripe.

  • You can cancel your subscription at any time; your access will continue until the end of your current billing period.

  • NDGE does not store your payment card details; these are processed securely by Stripe.

5. Acceptable Use

You agree not to:

  • Share your account or subscription with others.

  • Attempt to reverse-engineer or copy NDGE’s platform or audio content.

  • Upload or share harmful, offensive, or unlawful content.

  • Use NDGE in any way that breaches applicable laws or regulations.

6. Intellectual Property

  • All NDGE content, including audio sessions, scripts, design, and branding, is owned by NDGE and/or its licensors.

  • You are granted a personal, non-transferable, non-exclusive licence to access and listen to NDGE content for your own personal use.

  • You may not reproduce, distribute, or publicly share NDGE content without written permission.

7. Health Disclaimer

  • NDGE sessions are designed for general wellbeing and habit change, not for the treatment of medical or psychiatric conditions.

  • If you are in crisis, please contact a professional service such as Samaritans (UK: 116 123) or emergency services.

  • If you feel unwell, anxious, or distressed while using NDGE, stop the session and seek professional help.

8. Data and Privacy

Your use of NDGE is also governed by our Privacy Policy ([link to your Privacy Policy]). This explains what data we collect, how we use it, and your rights.

9. Termination

We may suspend or terminate your account if you:

  • Breach these Terms of Use

  • Misuse NDGE’s content or platform

  • Fail to pay subscription fees

10. Limitation of Liability

  • NDGE is provided “as is” without warranties of any kind.

  • We are not liable for indirect, incidental, or consequential damages arising from your use of NDGE.

  • Our maximum liability to you for any claim is limited to the amount you have paid for your subscription in the previous 3 months.

We may update these Terms from time to time. Changes will be posted on our website and will apply from the date of posting.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
